TATA CARA MEMPEROLEH IJIN MENDIRIKAN BANGUNAN (IMB) DALAM KAITANNYA DENGAN GARIS SEMPADAN BANGUNAN (GSB) (Studi Peraturan Daerah Nomor 5 Tahun 2001)

Abstract

The objective of this study is 1) to find out how to obtain BUILDING PERMITS in relation to the regulation of GSB Number 5 Year 2001; 2) to find out what are the problems pertaining this matter in Malinau Regency. As the era development and infrastructure growth specifically in the areas of building after the expansion of Malinau Regency based on UU Number 47 Year 1999 about the formation of the Nunukan, Malinau, West Kutai, East Kutai and Bontang. Malinau Regency has local regulations pertaining to this issue which was Perda Number 5 Year 2001 about permission to build which later replaced by Keputusan Bupati Number 176 Year 2002 about The Procedures of Getting Permission to set up a building. However, the fact shows that it does not implement well. Malinau Regency has a lot of old buildings and the fact that the local government quickly changed makes it even worst. This study found that many obstacles facing the society in getting IMB with relation to GSB and that is why the government's policies have not been fully implemented well.
