KORELASI BPJS KESEHATAN DALAM PENDAFTARAN PERALIHAN HAK ATAS TANAH DENGAN SYARAT SAHNYA SUATU PERJANJIAN

Sejak dikeluarkannya Instruksi Presiden Republik Indonesia Nomor 1 Tahun
2022 tentang Optimalisasi Pelaksanaan Program Jaminan Kesehatan Nasional serta
Surat Dirjen PHPT No.HR.02/153-400/II/2022 syarat pendaftaran peralihan hak atas
tanah atau biasa disebut balik nama karena jual beli harus menyertakan Kartu BPJS
Kesehatan atau dengan kata lain pembeli tanah harus merupakan peserta yang aktif
dalam program jaminan kesehatan. Tujuan penelitian yaitu mencari tau korelasi BPJS
Kesehatan dalam pendaftaran peralihan hak atas tanah dan juga harus memenuhi
syarat sahnya suatu perjanjian yang terdapat dalam pasal 1320 KUHPerdata.
Penelitian ini menggunakan metode penelitian hukum normatif atau kepustakaan
yang mengacu pada norma-norma hukum. Data yang diperoleh dianalisis
menggunakan metode deskriptif. Penelitian ini menunjukkan bahwa memang tidak
ada korelasi secara hukum antara syarat peralihan hak atas tanah dengan program
jaminan kesetahan berupa BPJS Kesehatan.

Abstract
Since the issuance of the Intruksi Presiden Republik Indonesia Number 1 of 2022
concerning Optimalisasi Pelaksanaan Program Jaminan Kesehatan Nasional and the
Surat Dirjen PHPT No.HR.02/153-400/II/2022 the registration requirements for the
transfer of land rights or commonly referred to as reverse name because the sale and
purchase must include a BPJS Health Card or in other words, the land buyer must be an active participant in the health insurance program. The purpose of the study was to find out the correlation of BPJS Health in registering the transfer of land rights and must also meet the requirements for the validity of an agreement contained in article 1320 of KUHPerdata. This research uses normative legal research methods or literature that  refers to legal norms. The data obtained are analyzed using descriptive methods. This research shows that there is indeed no legal correlation between the requirements for transferring land rights and the solidarity guarantee program in the form of BPJS Health.
